Welcome to Droplet. These Terms of Service ("Terms") govern your access to and use of the Droplet website at www.givedroplet.com and related services (the "Service") operated by Droplet ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old and a resident of the United States to use the Service. By creating an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate, current, and complete.
Droplet is a micro-donation platform that enables users ("Donors") to link bank accounts or credit cards, automatically round up everyday purchases to the nearest dollar, and donate the spare change to local fundraisers and nonprofits ("Organizations"). The Service includes donor dashboards, organization dashboards, bank account linking via Plaid, payment processing via Stripe, and automated round-up calculations and collections.
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@givedroplet.com of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
By linking a bank account or credit card, you authorize Droplet to access your transaction data through Plaid to calculate round-up amounts. You authorize Droplet to collect your accumulated round-ups on a weekly basis via ACH debit through Stripe. Round-up amounts are calculated as the difference between your purchase amount and the next whole dollar. You may set a weekly limit on round-ups, apply a multiplier, and pause donations at any time through your dashboard. A minimum balance of $0.50 is required before a weekly collection is processed. All donations are voluntary and non-refundable once processed, except in cases of unauthorized transactions or system errors.
Droplet charges a 7% platform fee on all donations to sustain operations and continue providing the Service. This fee is deducted before funds are distributed to Organizations. Donors may optionally add a tip to support Droplet, which is separate from the platform fee. There are no subscription fees, sign-up fees, or hidden charges for Donors.
Organizations that register fundraisers on Droplet must provide accurate information about their organization, including name, type, and contact details. Organizations must complete Stripe Connect onboarding to receive payouts. Payouts are processed bi-weekly and deposited to the bank account connected through Stripe Connect. Droplet reserves the right to review, approve, or remove any fundraiser that violates these Terms or misrepresents its purpose.
The Service integrates with third-party providers including Plaid (for bank account linking and transaction data) and Stripe (for payment processing and payouts). By using these features, you also agree to Plaid's End User Privacy Policy and Stripe's Terms of Service. Droplet is not responsible for the availability, accuracy, or practices of these third-party services.
You agree not to: use the Service for any unlawful purpose or to facilitate fraud; create multiple accounts to circumvent limits or abuse the platform; attempt to reverse-engineer, decompile, or disassemble any part of the Service; interfere with or disrupt the integrity or performance of the Service; scrape, harvest, or collect data from the Service without authorization; impersonate any person or entity or misrepresent your affiliation; use the Service to launder money or finance illegal activities; or submit false or misleading fundraiser information.
The Service, including its design, logos, text, graphics, and software, is the property of Droplet and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DROPLET DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF TRANSACTION DATA PROVIDED BY THIRD-PARTY SERVICES. DROPLET IS NOT A FINANCIAL ADVISOR, BANK, OR REGISTERED CHARITY AND DOES NOT PROVIDE FINANCIAL, TAX, OR LEGAL ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DROPLET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO DROPLET IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Droplet and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
You may terminate your account at any time by contacting us at support@givedroplet.com or through your account settings. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, any pending round-ups that have been collected but not yet distributed will be processed and donated to your selected causes. Your obligation to pay any outstanding amounts survives termination.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Virginia.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
